New regulations concerning remote work have come into force as stipulated by the Labor Code of the Republic of Armenia since November 25, 2023.
▪️ Remote work is the performance of an employee's job duties without being physically present at the workplace.
▪️ Remote work is conducted by mutual agreement between the employee and the employer (regardless of the form of ownership and organizational-legal type), provided that the essence of the work allows it to be done remotely.
▪️ Despite not being considered an essential working condition change, the agreement between the parties to perform work remotely must be documented in a writing form
▪️ During the period of performing job duties remotely, the employee must ensure the proper fulfillment of their job responsibilities and remain available to the employer in a mutually agreed manner. The failure to meet the requirements set forth in this clause due to the employee's fault is considered a violation of labor discipline.
▪️ Foreign nationals working remotely for an employer outside the territory of the Republic of Armenia are no longer required to have a residence status.
